TERMS OF SERVICE

AVAILABILITY & BOOKINGS

  1. KIWISOUNDS is open for business 24 hours a day / 7 days a week, including most public holidays.

  2. Bookings should be made in advance, ideally no less than 1 week prior to the intended session, to ensure availability. However we understand some projects crop up last minute, and we will do our best to accomodate these at short notice.

  3. The minimum period for a mobile/on-location booking is 2 hours, unless agreed otherwise.

  4. Cancellation of a booking should be made no less than 24 hours prior to the intended start time of a booking. If a cancellation is made less than 24 hours before the intended start time, KIWISOUNDS may charge a cancellation fee.

HIRE & PAYMENT

Charges

  1. KIWISOUNDS mobile recording service is available for hire for a standard hourly rate of $120 per hour. This includes equipment and an engineer/operator.

  2. All services offered by KIWISOUNDS, are billed at the standard hourly rate. This includes both work carried out on-site with the client and off-site without the client.

  3. KIWISOUNDS charges by the hour, though billing is typically in 15 minute increments.

  4. Setup and pack down of equipment, as well as sound checking, is billed at the standard hourly rate.

  5. A 50% deposit is required for all new client bookings. The remaining 50% is due upon completion of the project.

  6. A cancellation fee equal to 50% of the booked time period may be charged for cancellations made less than 24 hours prior to the intended start time of a booking.

Additional Charges

  1. Hire of additional personnel, session musicians, subcontractors etc., will be by agreement only, and will be billed in addition to the standard hourly rate.

  2. Hire of venues or any specialist equipment, will be by agreement only, and will be billed in addition to the standard hourly rate.

  3. Material costs or expenses incurred by KIWISOUNDS, such as CDs, DVDS, physical storage media, printing, licensing, web-hosting etc., will be billed in addition to the standard hourly rate.

  4. Travel time, depending on location, will be billed at the discretion of KIWISOUNDS, at the standard hourly rate.

  5. Travel costs or accomodation, if applicable, will be billed at cost price.

  6. Parking costs, if applicable, will be billed at cost price.

Billing Periods

  1. The billing period for on-site work, is from time of arrival to time of departure. This includes the setup and breakdown of equipment as well as sound, camera or lighting checks. During longer sessions, extended breaks, if taken, will be deducted. 

  2. The billing period for off-site work, is from start time to finish time spent working on a particular project or job. This includes but is not limited to the post-production processing of content, including editing, mixing, mastering and exporting.

Payment

  1. Payment must be made within 7 business days of the invoice date, unless agreed otherwise.

  2. Payment must be made in full, unless agreed otherwise.

  3. Payment must be made via cash, cheque or bank deposit.

Disputes

  1. KIWISOUNDS maintains accurate records of all billed work. This information typically includes client details, nature of the work, dates, locations, start and finish times, any extended breaks taken, travel times and incurred material costs and expenses. KIWISOUNDS endeavours to invoice clients as fairly and accurately as possible. If a dispute arises around billing, KIWISOUNDS will endeavour to resolve this without further conflict and on request will provide a full break down and justification of invoiced items including time sheets and material/expense receipts. On the rare occasion that a mistake is made during invoicing, KIWISOUNDS will endeavour to correct this and if payment has already been made, credit or refund the difference as soon as possible.

  2. If payment is not received within 7 business days of the invoice date, KIWISOUNDS will send a late payment notification. If payment is not received within another 7 business days of this notification, the overdue payment may be referred to a debt collection agency.

 

CONTENT

 

Quality

  1. KIWISOUNDS endeavours to provide a professional quality service that delivers high quality content. KIWISOUNDS uses a combination of high quality equipment and software to ensure recorded or produced content is of an acceptable professional standard. ​Audio is typically recorded at 48 kHz / 24 Bit or higher. Video is typically recorded in 1080p HD at 35 mbps or higher. Images intended for web use are created at 72 DPI or higher. Images intended for print use are created at 300 DPI or higher.

  2. KIWISOUNDS supplies content in a range of formats depending on client requirements. On occasion and by request content may be supplied in a compressed or lower quality format, including but not limited to MP3 audio files, lower resolution SD video files and JPEG image files. KIWISOUNDS is not responsible for client dissatisfaction caused by the inferior quality of these formats.

Ownership & Intellectual Property

  1. KIWISOUNDS retains ownership of all digital and physical recorded or produced content, as well as any and all original intellectual property created or produced by KIWISOUNDS, until payment has been made in full.

  2. KIWISOUNDS will only supply a digital or physical copy of recorded or produced content, after payment has been made in full. If content is of a physical nature (CDs, flash-drives, harddrives etc.), KIWISOUNDS may bill for the cost of the physical delivery medium and any relevant shipping costs.

Storage & Privacy

  1. KIWISOUNDS will keep a copy of all recorded or produced content for a period of 1 year, unless instructed or agreed otherwise, after which time it may be deleted.

  2. KIWISOUNDS may provide a private digital link to recorded or produced content, via a third-party provider such as Dropbox, Google Drive, One Drive etc., at no additional cost. This content will remain active and accessible for a period of 6 months, unless agreed otherwise, after which time it may be deleted.

  3. KIWISOUNDS will not share, distribute or use for promotional or financial purposes any client content or information without the expressed permission of the client.

 

Disputes 

  1. KIWISOUNDS will endeavour to correct any mistakes or errors, where it is at fault, as soon as possible and at no additional cost to the client.

  2. KIWISOUNDS is not responsible for client dissatisfaction caused by the quality of a client's performance.

  3. KIWISOUNDS is not responsible for client dissatisfaction caused by the display or playback of content on inferior or low quality equipment.

  4. KIWISOUNDS is not responsible for the clearance of copyrighted content, including any associated fees, that is supplied or used by the client. This includes but is not limited to, the recording or filming of copyrighted content (such as cover songs) and the use, display or live performance of copyrighted content (such as cover songs, backing tracks, music, images, videos etc).
