ABOUT US

TERMS OF SERVICE

 

AVAILABILITY & BOOKINGS​​​

  • Available 24/7, including public holidays.

  • Bookings ideally made at least 1 week in advance; short-notice requests accommodated where possible.

  • Minimum booking duration is 2 hours, unless otherwise agreed.

  • Please notify us at least 24 hours before your scheduled start time if you need to cancel. Cancellations made with less notice may incur a fee equal to 50% of the booked time.

HIRE & PAYMENT​​

  • Service rate: $120/hr (billed in 15‑minute increments), including equipment and engineer.

  • Deposit: 50% due at the time of booking; remaining balance due upon completion, unless otherwise agreed.

  • Billing includes setup, pack‑down, sound checks, and off‑site work. Additional charges may apply for personnel, venue hire, materials, travel, or parking.

  • Payment due within 7 business days of invoicing, via cash or bank deposit.

  • Late payment: Reminders sent after 7 days; invoices unpaid after 14 days may be referred for debt collection.

CONTENT QUALITY & DELIVERY​​

  • We record in professional formats (e.g., 48 kHz/24‑bit audio, 1080p or 4K video).

  • Clients may request lower-resolution formats; however, reduced quality is not eligible for refund.

 

OWNERSHIP & INTELLECTUAL PROPERTY​​

  • Ownership remains with KIWISOUNDS until full payment is received.

  • Physical media and third-party delivery services may incur additional costs.

  • Upon full payment, clients receive full usage rights to the delivered content. We may retain backup copies unless deletion is requested.

STORAGE & PRIVACY​​​

  • We retain content for 1 year (or as otherwise agreed).

  • Temporary digital links (e.g., via Google Drive) are available for 6 months unless arranged otherwise.

  • We collect and store client information solely for communication, invoicing, and service delivery.

  • We take reasonable steps to ensure all personal data is secure and protected against loss, misuse, or unauthorised access.

  • We will never use or share your content or personal information without your permission.

  • Clients may request access to, or correction of, their personal data at any time.

  • Some content may be stored using third-party platforms that operate internationally; we only use trusted providers that comply with data protection standards.

DISPUTE RESOLUTION & GUARANTEES​​

  • Services are delivered with reasonable care, skill, and within agreed timeframes.

  • If these standards are not met, you may request correction, re-performance, or a refund.

  • We will resolve billing or service concerns amicably and provide full documentation when requested.

  • KIWISOUNDS is not responsible for dissatisfaction resulting from client performance, playback equipment, or third-party copyright use.

  • Clients are solely responsible for securing the necessary rights to record or reproduce copyrighted material, including music, video, images, and backing tracks. KIWISOUNDS accepts no liability for unauthorised use.

  • We are not liable for delays, rescheduling, or service interruptions caused by circumstances beyond our reasonable control (e.g., illness, severe weather, equipment failure, venue access issues, or transport disruptions). However, in such cases, we will do our best to offer an alternative date or refund any deposits where appropriate.

 

LEGAL NOTICE

 

These terms are governed by New Zealand law and are subject to your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, and the Privacy Act 2020.
